1. Agreement to Terms

By accessing or using Gigtap ("the Service"), operated by Gigtap ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including contractors, business owners, and their clients who receive invoices or make payments through the platform.

2. Description of Service

Gigtap is an invoicing and payment platform designed for solo contractors and small trade businesses. The Service includes AI-powered invoice generation, payment processing through Stripe, job scheduling, expense tracking, and related tools. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.

3. Accounts and Registration

To use Gigtap, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must be at least 18 years old to use the Service. You agree to notify us immediately of any unauthorized access to your account.

4. Subscription and Billing

Gigtap offers a single subscription plan at $9.99 per month, which includes access to all features. New users receive a 3-day free trial with no credit card required. After the trial, you must subscribe to continue using the Service. Subscriptions are billed monthly and renew automatically. You may cancel at any time from your account settings, and cancellation takes effect at the end of your current billing period. We reserve the right to change pricing with 30 days advance notice.

5. Payment Processing

Gigtap uses Stripe to process payments between you and your clients. By using our payment features, you also agree to Stripe's terms of service. We are not responsible for payment processing errors, delays, or disputes that occur within Stripe's infrastructure. Transaction fees may apply as disclosed in your account dashboard.

6. AI-Generated Content

Gigtap uses artificial intelligence to generate invoice content based on your input. While we strive for accuracy, AI-generated invoices may contain errors. You are responsible for reviewing and approving all invoices before sending them to your clients. Gigtap is not liable for any losses, disputes, or damages resulting from inaccurate AI-generated content.

7. Acceptable Use

You agree not to use Gigtap to:

  • Create fraudulent, misleading, or illegal invoices
  • Violate any applicable laws, regulations, or third-party rights
  • Transmit malware, spam, or other harmful content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for money laundering or other financial crimes
  • Resell or redistribute the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual Property

The Gigtap platform, including its design, code, logos, and content, is owned by Gigtap and protected by intellectual property laws. You retain ownership of the data you create using the Service, including your invoices, client information, and business records. By using Gigtap, you grant us a limited license to use your data solely to provide and improve the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Gigtap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to Gigtap in the 12 months preceding the claim.

10. Disclaimer of Warranties

Gigtap is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not a financial advisor or accounting firm, and the Service should not be considered a substitute for professional financial or legal advice.

11. Termination

You may terminate your account at any time by canceling your subscription and deleting your account from the settings page. We may terminate or suspend your account if you violate these terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email or through a prominent notice on the platform at least 14 days before changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the courts of Estonia.
